The internet industry is suing the state of California over its days-old net neutrality law.

The lawsuit, filed on Wednesday by major trade groups representing broadband companies, is the second major lawsuit filed against the state over the law — the first was brought by the Justice Department.

On Sunday evening, California Governor Jerry Brown signed what is considered to be the strictest net neutrality law in the country. Under the law, internet service providers will not be allowed to block or slow specific types of content or applications, or charge apps or companies fees for faster access to customers.

Hours later, the federal government filed a lawsuit in which it alleged that California was “attempting to subvert the Federal Government’s deregulatory approach” to the internet. The DOJ argues states can’t pass their own laws governing internet companies, because broadband services cross state lines. It is fighting the state over a clause in the 2017 order repealing Obama-era federal net neutrality protections. In that order, the FCC said it could pre-empt state-level net neutrality laws.

The impending legal battle could drag on for many months if not longer, Daniel Lyons, an associate professor at Boston College Law School who specializes in telecommunications and Internet regulation, told CNN.

A lot is riding on the outcome. The California law is considered the most thorough state-level net neutrality legislation yet passed, and other states are expected to use it as a blueprint for their own laws.

If California wins in court, it would open the door for those other states to take similar actions. However, the FCC could try to come back with an order to block their efforts again, Lyons said.

California will likely claim that the pre-emption provision is invalid, Lyons said, while the federal government will attempt to get an injunction to stop the law from taking effect. in doing so, it will claim that the law will cause harm if allowed to take effect.

“These attempts at getting a preliminary injunction seem weak and are likely to fail for the same reasons that the Internet Service Provider [ISP] industry was unable to obtain a stay of the FCC’s former net neutrality rules in 2015,” said telecommunications attorney Pantelis Michalopoulos, a partner at Steptoe & Johnson LLP who has argued net neutrality cases. “The Internet Service Providers offer speculative theories about why they will suffer irreparable injury. These theories do not appear to satisfy the test for a preliminary injunction.”

The industry groups taking part in the new lawsuit represent major companies including AT&T, Comcast and Verizon, as well as other cable companies and wireless providers across the US. The groups had previously lobbied against the state law. (CNN is owned by AT&T.)

“We oppose California’s action to regulate internet access because it threatens to negatively affect services for millions of consumers and harm new investment and economic growth. Republican and Democratic administrations, time and again, have embraced the notion that actions like this are preempted by federal law,” the trade groups USTelecom, CTIA — The Wireless Association, The Internet & Television Association, and the American Cable Association said in a statement. “We will continue our work to ensure Congress adopts bipartisan legislation to create a permanent framework for protecting the open internet that consumers expect and deserve.”

In a statement Wednesday afternoon, Attorney General Xavier Becerra indicated the state would fight to protect its new law.

“This suit was brought by power brokers who have an obvious financial interest in maintaining their stronghold on the public’s access to online content. California, the country’s economic engine, has the right to exercise its sovereign powers under the Constitution and we will do everything we can to protect the right of our 40 million consumers to access information by defending a free and open Internet,” Becerra said in a statement.

State Senator Scott Wiener, a co-author of the bill, previously told CNN he expected the ISPs to sue over the law.

“The internet service providers have every right to sue California, just like California has every right—indeed an obligation—to protect our residents’ access to an open internet,” Wiener said after the trade groups filed their suit.

Nollywood Actress Diagnosed With Bipolar Disorder After ‘Break Up’ With Husband

Ebonyi State-born Nollywood actress, Chacha Eke Faani, has stirred mix reactions on social media after posting a video to disclose that she is diagnosed with bipolar disorder.

Five days earlier, the actress shared a video to announce breaking up with her husband, Austin Fanni, leading to assertions by her fans and colleagues that the break up is as a result of domestic violence.

Chacha and Austin had been married for seven years and had three children together. However, the actress in the video posted on her Instagram account on October 3 called her marriage a quit.

“Some people say I am crazy but I am not and I am doing this video to let the whole world know that I am done with the marriage. I don’t have a lot to prove that I am done with him but am done, am leaving with my life,” said Chacha in the video.

However, barely a week after Chacha made the first declaration, she posted another video on Wednesday night, October 7, vindicating her estranged husband noting that he never laid his hands on her.

She said, “Five days ago I made a video saying that my marriage to Austin Faani is over and that video came with a lot of backlash from people with many insinuating that it is a clear case of domestic violence,” said in the video recorded from her hospital bed in Asaba, the Delta State capital.

“It is not. Austin has never laid his hands on me. He has never even raised his voice at me and God in heaven knows that’s the truth. I am here at First Delta American hospital in Asaba receiving treatment.

“Many psychiatrists have come to assess me mentally and I have been diagnosed of suffering from bipolar disorder.

“Bipolar is real. Here in Africa, we tend not to know about it due to ignorance. I cannot tell how I have been feeling with these videos that I have been making,” said Chacha, looking pale and depressed.

UNILAG Announces Date And Procedure For Post-UTME (See Details)

The University of Lagos (UNILAG), has announced that its 2020 post-Unified Tertiary Matriculation Examination (UTME) test will hold as from November 18.

The examination will hold for two weeks and end on December 2.

This was confirmed in a statement on Thursday by Mr. Oladejo Azeez, the Registrar of the school.

According to the statement, online registration for this year’s post-UTME exercise will start on Monday, October 19, and end on Friday, October 30.

All candidates seeking admission into the University for the various undergraduate courses/programmes of the university for the 2020/2021 academic session are expected to participate in the exercise.

The Registrar, however, noted that only candidates who made the university their first choice in the 2020/2021 UTME and scored 200 and above would be eligible for the screening.

Also, eligible candidates must possess five credit passes at one sitting in relevant ‘O’ Level subjects, including English Language and Mathematics and must be at least 16 years of age by Oct. 31

The statement added that “Candidates who fail to participate in the post UTME screening will not be considered for admission.

“Former students of the institution whose admissions were withdrawn on the basis of poor academic performance or absence status, could re-apply on the condition that the new admission shall be for a course/ programme different from the former course/programme.

“Any student expelled from the university cannot be offered fresh admission,” he said.

To apply, candidates are to log in to the university’s website www.unilag.edu.ng and click on admission. They would be expected to pay the sum of N2,000 as the screening fee.

The Registrar said: “Click on post-UTME application, then login with UTME number as username and Surname ( in lowercase) as password.

“Generate and print payment advice and proceed to any commercial bank to make the payment or pay online.

“Return to the university portal to complete filling the screening form and then print post-UTME examination pass.”

Meanwhile, the Chairman of the University of Lagos, UNILAG chapter of the Academic Staff Union of Universities (ASUU), Dr Dele Ashiru, two weeks ago noted that the union is still on strike.

Ashiru, who is also a member of the National Executive Committee of the union, said the union was still on strike in reaction to reports that the union had called off its strike and ordered lecturers to return to classes.

“If we are going to call off our going strike, there is a process that will be followed and nothing of such has been done,” he said.

#EndSARS: Youths Kick Off Protest Against Police Brutality In Kwara State (Picture)

Protests against the Special Anti-Robbery Squad (SARS) kicked of today as concerned youths in Kwara State called on the government to totally scrap the Special Anti-Robbery Squad (SARS).

The protests started at the popular Post Office bridge down to the Police Headquarters in the State and down to the Government house.

Stating their demands to the Nigerian government and the Police Force during the exercise, The protesters demanded total disbandment of the SARS and AKS Squads in the country.

Some of the inscriptions on the placard read: ‘End SARS now’; “say no to reformation of SARS’; ‘police protect us, police stop killing us,’ “the only SARS we want is SARS on the beat,’ ‘stop killing our youths. Stop killing our male child.

Convener of the protest, Miss Saadat Bibire, said the peaceful protest became important in view of gross misconduct and atrocities being perpetrated by men of the SARS.  She noted it was the duty of the Nigerian Police to protect and ensure safety of citizens and not on the contrary.

One of the protesting youths, Abdulsalam Abodurn, who also decried alleged extortion by men of the SARS, accused some them of collectingN50,000 from him, because they could not understand the use of an application on his phone which he used to communicate with his clients as a creative writer.

The Deputy Commissioner of Police, Mr. Paul Omata hailed the peaceful and orderly conduct of the youths while the protest lasted.

He assured their grievances would be relayed to the Inspector General of Police, whom he said had already started taking steps towards addressing some of the issues raised.

Mosquito Bite Turns Man’s Leg To Almost The Size Of His Body – [Photos]

A young man’s leg has been turned to almost the size of his body after he was reportedly bitten by a parasite career mosquito.

According to reports, the young man who is now 27 years of age was bitten by the infected mosquito while he was just six years old.

Bong Thet who hails from Cambodia, a country in the Southeast Asian while narrating his ordeal said he once dreamed of becoming a footballer, but now have to drag his foot as a result of the incident which happened two decades ago.

Thet’s leg developed from a small wound into a huge tumour after he was ignored by his parents who thought it was a mare injury from the playground.

According to the young man, the small lumps grew around his foot and completely covered his leg by the time he reached 12-years-old. The leg, however, became terrible and scary due to his inability to afford the medical treatment in the poverty-stricken country.

Naija News understands that Bong’s condition forced him out of school because it became very difficult for him to walk long distances until of recent he met with a good Samaritans who offered to pay for his treatment.

Businesswoman Dana Try reportedly gave Bong’s family 10,000,000 Cambodia Riel (around £1,900) for his medical expenses and he was able to visit a hospital for the first time. According to reports from doctors after conducting a blood check-up, Bong has Lymphatic filariasis, a parasitic disease caused by thread-like worms.

The doctors confirmed that he contracted the parasites through mosquito bites which he scratched, resulting to the wounds, adding that the parasitic disease is one of the leading causes of disability in the world, but there is no known vaccine or cure for the disease yet.

The young man when he was told of how his condition has worsened and is incurable, he was disheartened but he was still thankful to people who contributed for his checkup.

“This will make my life easier and knowing that there are people who care for me makes me feel happy,’ he said. ‘I am so grateful for them to helping. The money will pay for medicine and food,” he said.

“I will continue to take the medication given to me by the doctors which will make my life more comfortable.”

The NFF in a tweet on Thursday said the COVID-19 test results for players in Austria for friendlies with Algeria and Tunisia on Friday and Tuesday respectively are awaited.

NFF tweeted, “Please discountenance any reports that some of our players tested positive to COVID 19 ahead of tomorrow’s friendly game against Algeria.

“It is a blatant falsehood.

“The writer of the story, who was not part of the press conference earlier today, totally misrepresented what Coach Rohr said that since the outbreak of the pandemic, four of our players had tested positive, but were all now fully recovered from the virus and back in action.

“The results of the COVID 19 tests carried out on the Super Eagles ahead of tomorrow’s game are still being awaited.”
